Parole Absconding - Tamil Nadu
Issue Date: 2018
Abstract: Prison is a state subject according to the VII Schedule of the Indian Constitution; hence every state has its own kind of correctional administration. There are many devices adopted by the Prison administration to ease tension in the prison, one of the most important devices for reducing pressure in prison is the selective release of prisoners on parole/leave. But many times the leave is misused by the leave absconders which affects the correctional administration. According to the Tamil Nadu Prison Manual, 1982- the word parole is not used in Tamil Nadu from the year 2008, instead the word Leave is used. Generally there are two types of leave given to the Prison Inmates in Tamil Nadu; they are Emergency Leave and Ordinary leave. The emergency leave is granted 15 days in a year, which will be given in a span of four spells and the ordinary leave is given to the good conduct prisoners once in two years, in a span of one month. Even though leave granted to them, is not a right of a prisoner, but the Prison Department considers the same for the psychological well-being of the inmates and welfare of the family of the inmate. But sometimes these inmates during their leave abscond and are often recaptured after few years. The major objective of this study is to explore the reason behind leave absconding. This research study adopts case mixed method. This research profiles the leave absconders in Tamil Nadu and describes the social, demographic and criminal history of this group. The research will provide the status of leave absconders in Tamil Nadu and also the reason behind absconding.
